This is the situation where Elise wanted to come up (leeward boat from a bunch of starboard tackers, so with rights) but could not as the boat to the right would not give way (in order probably to get a better position on the line?) even though there was plenty of space to do that. When politely ask to come up, the answer was 'you can't touch me', which is technically true as we need to avoid collision and contact, even if we have rights. Worth a protest? Of course not. Worth a nice note after the race? Could have been nice.
